As a separate legal entity, an incorporated company can be the subject of a claim or complaints arising from the provision of dental services.  Individual practice principal membership would not extend to include assistance for an incorporated business, which requires its own protection. With recent legal challenges relating to claims arising from alleged vicarious liability and non-delegable duty of care, dental companies may now find themselves at greater risk of being the subject of a claim.

What is Company Protection?


Company Protection is a membership for the entity itself that allows directors/corporate officers to request assistance should legal challenge be brought against the company/entity. This product sits separately and in addition to your individual practice principal membership with Dental Protection. It’s optional to apply, but Dental Protection will be unable to support with a case against an incorporated company without Company Protection membership. 

Please note that whilst your individual Practice Principal membership is provided on an occurrence basis, Company Protection membership is offered on a claims-made basis. This is considered the most suitable type of protection for dental companies and allows assistance to be requested for claims or complaints that arise from an adverse incident that occur during the company’s current membership with Dental Protection.

Company Protection at-a-glance


  • Claims indemnity limit of £1m for each claim and in the aggregate
  • Up to 10 years retroactive protection.  Requests for greater than 10 years will be individually considered*
  • Redirection of claims that assert the company as being vicariously liable or having a non-delegable duty of care
  • Defence costs for legal proceedings brought against the organisation where efforts to deflect the claim onto the treating clinician have failed, if applicable
  • Payment of compensatory damages for any claims brought against the organisation where they are found to have vicarious liability or a non-delegable duty of care, if applicable
  • Access to dentolegal advice and support
  • Help from our Press Office with unwanted media attention

Who is eligible? 


Any incorporated dental company with employees and a gross annual turnover of less than £6m can apply for Company Protection. 

If your company has a turnover of £6m or more, please visit healthcareprotection.org to find out more about our insurance offering for dental corporates.

Apply for Company Protection


Company Protection is a membership for the entity itself, allowing directors/corporate officers to request assistance should legal challenge be brought against the company/entity. Subscription rates are based on the individual circumstances of your company.  For example, the number of dentists and other employees working within the company, the number of Dental Protection members, and the level of retroactive protection required.* Here are some examples of what different limited companies can expect to pay:

These prices are example only, based on the circumstances cited. Each Company Protection membership is priced based on individual circumstances of the company. 

You can apply by completing the Company Protection application form. Please complete a separate version of this form for each limited company that you’re seeking protection for. For example, if you are applying for membership for three limited companies, three separate versions of this form would need to be completed. As separate entities, each limited company will hold separate membership agreements.

*The option to add retroactive protection is only available for Company Protection applications made before 1st June 2024. From the 1st June anyone applying for Company Protection will be purchasing from the date of the application rather than the date of incorporation.
