When all hope looks lost

A dentist appeared before her national registration body as a result of a complaint received from a patient. She was found guilty of serious professional misconduct. It was felt that she had not sufficiently updated her practice procedures or her clinical knowledge and did not sufficiently communicate with her patients to allow her to practise without concern for public safety or interest.

After being found guilty, the body was entitled to suspend or erase the dentist’s name from the dental register. Dental Protection advised the registration body that it would supervise the dentist’s programme of improvement if the practitioner were to be allowed to continue in practice.

The body accepted this option and directed that the dentist’s registration be conditional on her compliance with specified improvement targets over a period of one year. A dento-legal adviser from Dental Protection worked closely with the dentist during that time to develop a programme that included professional development, risk management and regular patient surveys that were later presented as evidence. At review, the dentist was unconditionally restored to the register.

Learning point:

Advice from some colleagues, even though well-intentioned, may be worth reviewing with a dento-legal adviser from Dental Protection, particularly when it involves interpretation of a dental contract.
